1. Agreement to these terms

These Terms of Service ("Terms") govern your access to and use of HostCarbonX websites, billing systems, and hosting services including shared web hosting and unlimited hosting plans.

By registering an account, placing an order, or using our services, you agree to be bound by these Terms, our Privacy Policy, Acceptable Use Policy, and Refund Policy. If you do not agree, do not use our services.

If you are entering into this agreement on behalf of a company or organization, you represent that you have authority to bind that entity.

2. Services we provide

HostCarbonX provides web hosting infrastructure and related services, which may include:

• Shared and unlimited web hosting with storage, bandwidth, and email resources as described in your plan.
• Website control panel access, SSL certificates where included, and standard server software.
• Technical support for hosting infrastructure as described in your plan tier.
• Optional add-ons such as domains, backups, or premium support where purchased separately.

Specific resource limits, features, and pricing are defined on our website and in your order confirmation. We may update plan features over time but will not materially reduce paid resources during an active prepaid term without notice.

3. Account registration and security

You must provide accurate, current, and complete information when creating an account. You are responsible for:

• Maintaining the confidentiality of your login credentials and control panel access.
• All activity that occurs under your account, whether authorized by you or not.
• Notifying us immediately if you suspect unauthorized access or a security breach.
• Ensuring contact and billing information remains up to date.

We may suspend or terminate accounts that contain false information or are used in violation of these Terms.

4. Acceptable use policy

You may use HostCarbonX services only for lawful purposes. You must not use our platform to host, transmit, or distribute content or conduct activities that:

• Violate any applicable local, national, or international law or regulation.
• Infringe intellectual property, privacy, or other rights of third parties.
• Distribute malware, viruses, phishing pages, spam, or unauthorized bulk email.
• Launch denial-of-service attacks or attempt to gain unauthorized access to systems.
• Mine cryptocurrency or run resource-intensive processes that degrade shared server performance unless explicitly permitted on your plan.
• Host pirated software, illegal streaming, or other prohibited content.
• Harass, threaten, or abuse others.
• Resell or sublicense shared hosting resources beyond what your plan allows.

We reserve the right to investigate suspected violations and suspend or terminate services without refund where abuse is confirmed.

5. Resource usage and fair use

Each hosting plan includes defined limits for storage, bandwidth, CPU, memory, inodes, email accounts, and databases. "Unlimited" features are subject to fair use policies and are intended for normal website operation — not bulk file storage, backup warehousing, or activities that negatively impact other customers on shared infrastructure.

If your usage consistently exceeds reasonable limits for your plan type, we may ask you to upgrade, optimize your site, or move to a more suitable service. Failure to comply may result in throttling or suspension.

6. Billing, renewals, and payments

Hosting services are billed in advance according to the billing cycle you select (monthly, annually, or multi-year terms where offered). By placing an order, you authorize us to charge the applicable fees.

• Prices are listed in Indian Rupees (INR) unless otherwise stated and may be subject to applicable taxes.
• Services renew automatically at the end of each billing term unless you cancel before the renewal date.
• Failure to pay renewal invoices may result in suspension and eventual termination of services.
• Promotional pricing applies only for the advertised term and reverts to standard pricing on renewal unless stated otherwise.
• Chargebacks or payment disputes initiated without contacting support first may result in immediate account suspension.

7. Service availability and maintenance

We strive to maintain reliable hosting infrastructure and target high uptime for production services. However, uninterrupted availability is not guaranteed. Scheduled maintenance, emergency repairs, upstream provider issues, and events outside our reasonable control may cause temporary service interruption.

We will use reasonable efforts to notify customers of planned maintenance that may affect service. No credit or refund is owed for brief interruptions unless expressly covered by a written service level agreement.

8. Backups and data responsibility

You are solely responsible for maintaining your own backups of website files, databases, and email data unless a paid backup service is explicitly included in your plan.

HostCarbonX is not liable for data loss caused by customer error, third-party software, security incidents, or failure to maintain backups. We recommend regular off-site backups for all production websites.

9. Support scope

Our support team provides assistance with hosting infrastructure, account access, and platform-related issues. Unless you purchase a managed plan, support does not include:

• Custom website or application development.
• Debugging third-party themes, plugins, or scripts.
• Recovery from compromised sites where customer negligence contributed to the breach.
• Migration from unsupported or misconfigured third-party environments beyond standard scope.

Support is available through our ticketing system and documented channels. Response times vary based on issue severity and plan type.

10. Suspension and termination

We may suspend or terminate your account immediately if:

• You violate these Terms or our Acceptable Use Policy.
• Your account is associated with abuse, fraud, or illegal activity.
• Payment is overdue and not resolved after notice.
• We are required to do so by law or by order of a competent authority.

You may cancel services at any time through your account panel. Cancellation stops future renewals but does not automatically entitle you to a refund except as stated in our Refund Policy. Upon termination, we may delete Customer Content after a reasonable grace period.

11. Intellectual property

HostCarbonX retains all rights to our brand, website, control panel software, documentation, and proprietary systems. You may not copy, modify, or reverse engineer our platform except as permitted by law.

You retain ownership of your website content and trademarks. You grant us a limited license to host, store, and transmit your content solely to provide the services you purchased.

12. Disclaimer of warranties

To the fullest extent permitted by law, HostCarbonX services are provided on an "as is" and "as available" basis. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that services will be error-free, secure, or uninterrupted.

13. Limitation of liability

To the maximum extent permitted by applicable law, HostCarbonX and its directors, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption, arising from your use of our services.

Our total liability for any claim relating to a specific service shall not exceed the amount you paid to HostCarbonX for that service during the twelve (12) months preceding the event giving rise to the claim.

14. Indemnification

You agree to indemnify and hold harmless HostCarbonX from claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of our services, your Customer Content, your violation of these Terms, or your infringement of any third-party rights.

15. Governing law and disputes

These Terms are governed by the laws of India. Any dispute arising from or relating to these Terms or our services shall be subject to the exclusive jurisdiction of the courts located in India, unless otherwise required by mandatory consumer protection law.

16. Changes to these terms

We may modify these Terms at any time. Material changes will be posted on this page with an updated date. Your continued use of services after changes become effective constitutes acceptance. If you do not agree to revised Terms, you must stop using our services and cancel your account.
